How is the US judicial system different from the French judicial system ?

First of all, there are some differences between the US judicial system and the French system. In fact, the structure of this system is different in the two countries. In France, there is a hierarchy of courts. There are courts of first instance, the courts of appeal and finally the highest court, the Cour de cassation. Whereas, in the American system there are courts specially set up to judge cases relating to federal laws, The Federal Court of Appeal; and state courts, which only judge cases concerning state laws. There is one of this court per state. There are also differences in the penalties applied. In the United States still has the death penalty, whereas in France it isn’t used anymore. In addition to, there is also a difference between the way a case is judge in France and in the USA. In France, professional magistrates judge the case, in contrary to, in the United States juries, there are ordinary people present during the trial who determine if the accused is guilty or not. Despite, there are similarities between these two systems. We have a multi-jurisdictional system, and the laws who protect fundamental rights.

In giving an objective opinion, I thought, both systems have good and bad things. As far as I’m concerned, the penalties in the US judicial system are more appropriate, unlike in France, where I find that some penalties are light compared to the crime committed. But when it comes to judging, I prefer the French system, because it’s more legitimate fore cases to be judged by professionals.
